1. INTRODUCTION

1.1 PURPOSE OF POLICY.

AdU Network LLC, a California limited liability company d.b.a. Spring Theory (“us,” “we,” or the “Company”), which provides and operates the website located at www.SpringTheory.com and any and all other websites at which this Privacy Policy is posted (collectively, the “Site”), together with a range of related products and services, is committed to respecting the privacy rights of visitors to and users of the Site. We created this Spring Theory Privacy Policy (this “Policy”) to give you confidence as you visit and use the Site, and as you use the software, product data, editorial content and other content and services available from us or from the Site (such software, content and services and sites being referred to herein collectively as the “Services”), and to demonstrate our commitment to fair information practices and the protection of privacy. This Policy is only applicable to the Site and the Services. This Policy does not apply to any other websites that you may be able to access from the Site, each of which may have data collection and use practices and policies that differ materially from this Policy, nor does it apply to any services that may be offered by the Company’s business partners, where your personally identifiable information is collected by anyone other than the Company. 1.2 Notice Concerning Children

PLEASE NOTE: We are a general audience site, and do not direct any of our content specifically at children under 13 years of age. We understand and are committed to respecting the sensitive nature of children’s privacy online. If we learn or have reason to suspect that a user of the Site or the Services is under age 13, we will promptly delete any personal information that might be stored in that user’s account.

1.3 NOTICE REGARDING INTERNATIONAL USERS

The Site and our Services are hosted in, and are intended for users from, the United States. 2. Information Collection Practices

2.1 What PERSONAL information DO WE collect?

(a) BASIC PERSONAL INFORMATION. In operating the Site and providing the Services, we may collect a variety of user-submitted information such as names, addresses, phone numbers, email addresses, user photos/images/likenesses, and other contact or identifying information, in order to establish and authenticate user accounts, to facilitate certain features we offer, to identify users while on the Site or using the Services, to enable interactions between users, and to send information and notices to our users regarding the Site and the services we offer. In addition, we may provide registration forms, discussion forums, comment forms, online surveys, and other online forms that ask users to provide their names, e-mail addresses, mobile phone numbers and other contact information, as well as information related to the subject matter of the activities requiring registration, the surveys or of the other online forms. Also, if you communicate with us by e-mail, post messages to any of our chat groups, bulletin boards, message areas, or forums, submit any review forms, tips or tricks, or otherwise complete online forms, surveys, or contest entries, any information provided in such communication may be collected as personal information.

(b) LOCATION-BASED INFORMATION. The Services may include so-called “location-based services” that, for example, ask you to “check in” at a location or post or otherwise broadcast your location to other users of the Site and the Services. If you choose to enable these location-based services and check in or otherwise identify your location to the Site or through the Services, then the location you provide will be part of the information about you that we collect.

(c) TRANSACTION-RELATED INFORMATION. In addition to the foregoing, because we sometimes offer our customers online payment options, and because we may from time to time offer certain services that require payment by credit card or with an online payment processor, if you elect to make any online payment through the Site or with the Services, we will collect (or contract with a trusted third party to collect) a credit card number or other payment information and your address and other billing information in order to validate and process the transaction.

2.2 What additional information DO WE collect?

(a) AUTOMATIC COLLECTION. Our servers automatically recognize visitors’ domain names and IP addresses and may also identify your computer and connection information, as well as information about your browser type and browser settings and (where possible) your geographic location. No personal information about you is revealed in this process. The Site may also use clear gifs (also known as web beacons) and other methods to gather anonymous “traffic data” that does not personally identify you, but that may be helpful for marketing purposes or for improving the services we offer. We may also use clear gifs in email messages that we send to our users so that we can track which recipients have opened those messages.

(b) COOKIES. From time to time, we may use the standard “cookies” feature of major browser applications that allows us to store a small piece of data on your computer about your visit to the Site. We do not set any personally identifiable information in cookies, nor do we employ any data capture mechanisms on the Site other than cookies. Cookies help us learn which areas of the Site are useful and which areas need improvement. You can choose whether to accept cookies by changing the settings on your browser. However, if you choose to disable this function, your experience at the Site may be diminished and some features may not work as they were intended.

3. Use and Sharing of Information

3.1 WHAT DO WE DO WITH PERSONAL INFORMATION WE COLLECT?

You always have the option not to provide us with any personal information. Your decision not to do so, however, may limit your ability to access areas of the Site or features of the Service that require you to be logged in. If you do elect to provide any personal information to us, then we will use that personal information to provide you with access to the Site and the Services offered by us or to comply with the law, and we may share that information as follows:

(1) If we allow you to post to the Site or through the Services, then we may identify you by your user name and with the profile picture or other image (if any) that you have selected as your identifier. If you have enabled location-based services and are posting content that includes location information, your location will be part of the information about you that is publicized to other users who review that content.

(2) Because we sometimes work with affiliated businesses that we do not control, in some cases, you may be entering into correspondence or possibly transactions (that include the disclosure of your personal information) with one of these affiliated business. You will be notified any time a transaction involves a third party, and we will share your information with that third party as necessary to complete your transaction.

(3) At some point in the future, the Services may allow you to connect with and create your user account using certain third-party services (such as Twitter, Facebook and other similar services). If you connect to us and create an account using a third-party service, then we will obtain your user information from that third-party service, and your account will contain the information provided by that third-party service. If this option is available and you want to connect with us and create your account through a third-party service, please make sure you are familiar with and in agreement with the ways in which that third party service will share your personal information. Similarly, if you use our Site or Services to provide information to those third-party services (such as by authorizing us to update your Facebook status or send Twitter an update that you have provided or created through the Site or our Services), the information will no longer be under our control, and will instead be subject to the privacy policies and other terms of use of those third party services. It is up to you to control whether your Site and Services activities are provided to third party services.

(4) From time to time, we may employ other companies and individuals to perform services for us, such as order processing and fulfillment, credit card processing and related financial services, customer service and technical support, data analysis, marketing assistance, and mailing (postal and email) assistance. These companies and individuals may have access to your personal information so that they can perform their responsibilities, but will not be permitted to use that information for any other purposes. In addition, we may from time to time elect to share personal information about our users with our trusted business partners. We will not be selling personal information to our business partners, and any business partner with access to user information will have signed and agreement with us to protect the confidentiality of that information. You can request that we not share your personal information with our business partners, but if you do so, we may not be able to provide you with the full range of features, services and offers available from the Site and through the Services.

In addition, we may use your personal information to verify your identity, to check your qualifications, or to follow up with transactions initiated on the Site or through the Services. We may also use your contact information to inform you of any changes to the Site or the Services, or to send you additional information about us. If you give your permission during any account registration process, we may share your contact information with our business partners or other companies so that they may send you promotional materials or otherwise contact you regarding services that they offer that may be relevant to your use of the Site or the Services.

3.2 WHAT DO WE DO WITH ANONYMOUS INFORMATION WE COLLECT?

We use anonymous information to analyze our Site traffic and Services use, but we do not examine this information for individually identifying information. In addition, we may use anonymous IP addresses to help diagnose problems with our server, to administer the Site and the Services, or to display the content according to your preferences, and we may use clear gifs to anonymously track how users are using the Site and to improve our reporting and marketing systems. Traffic and transaction information may also be shared with business partners and advertisers on an aggregate and anonymous basis.

3.3 HOW DO WE USE COOKIES?

We may use cookies to deliver content specific to your interests, to save your user ID or password so you don’t have to re-enter it each time you visit our site, or for other purposes. Promotions or advertisements displayed on our site may contain cookies. We do not have access to or control over information collected by outside advertisers on our site.

3.4 IN WHAT CIRCUMSTANCES WILL WE DISCLOSE PERSONAL INFORMATION?

In addition to disclosures described above, we may disclose personal information if required to do so by law or in the good-faith belief that such action is necessary to (1) conform to the edicts of the law or comply with legal process served on us or our parent company, subsidiaries or affiliates, (2) protect and defend our rights or property or the rights or property of users of the Site, (3) enforce our Terms of Use or other agreements, or (4)  protect the rights, property or safety of the Company, users of the Site or Services, or others.

3.5 WHAT HAPPENS IF COMPANY IS ACQUIRED?

In order to accommodate changes in our business, we may sell our company or portions of our company or sell or buy portions of other companies or assets, including the information collected through the Site and the Services. If the Company or substantially all of its assets are acquired, customer information will be one of the assets transferred to the acquirer.

3.6 HOW CAN YOU ACCESS AND/OR REMOVE YOUR INFORMATION?

You can notify us at any time that you want to terminate our storage of your personal information, and upon receipt of that notice, we will remove all information about you from our database, at which point you will no longer be able to access any of our services that require registration unless you re-register. Unfortunately, we do not maintain any procedures for you to review or request changes to the information that we collect about you; your only option at this time is to request deletion of all personally identifiable information about you in our databases. Also, keep in mind that any information or content that you have posted to public areas of the Site (which may include comments, ratings, reviews, photographs or images) will remain on the Site for the benefit of other users irrespective of the status of your user account. The deletion of your personal information from our database will not cause the removal of any content you had previously provided to the Site or through the Services.

4. Security

The Company, the Site and the Services have security measures in place to prevent the loss, misuse, and alteration of the information that we obtain from you, both during transmission and while stored by us, but we make no assurances about our ability to prevent any such loss, misuse, or alteration, and we and our owners, partners and affiliates will have no liability to you or to any third party arising out of any such loss, misuse, or alteration. In addition, your personal account information will be protected by a user name and password that you select, and it is up to you to protect the confidentiality of your login information and prevent unauthorized access to your account. The Terms of Use contain additional terms that apply to the use and protection of your user name and password.

5. Website Areas Beyond OUR Control

5.1 Public Forums

The Site may include, or the Services may offer you access to, interactive forums such as blogs, message boards, public forums, messaging, comment areas and live chat features and other publicly viewable communication platforms. Please remember that any information that is disclosed in many of these areas becomes public information (available to other users who are also participating in those areas), and we recommend that you exercise caution about disclosing your personal information when using any of these public forums. We have no control over the use of any personal information disclosed in a public forum, and you are solely responsible for the effects of any such disclosure.

5.2 Third Party Websites

The Site and the Services may contain third-party advertising and links to other websites. If you choose to click on advertisements or visit other websites, we are not responsible for the privacy practices of those advertisers or other websites, and it is your responsibility to review their privacy policies and terms of use to confirm that you understand and agree with their policies. In addition, in no event will we have any responsibility for the contents of those advertisements or other websites, and you click on advertisements and visit and use third-party websites entirely at your own risk.
